In the spring of 2023, HB403 was passed, laying the groundwork for a more regulated hemp marketplace in Tennessee. Since then, we’ve been waiting for the official rules that would define how the law would be implemented. Unfortunately, the permanent rules were just published, and despite our ongoing efforts to advocate against it, the sale of THCA flower and other smokable products will be banned starting in January 2025.

New Permanent Rules Published

On October 1, 2024, the Tennessee Department of Agriculture published permanent rules that will officially go into effect on January 1, 2025. While the goal was to create clarity and safety for consumers, there’s one major change that’s set to impact THCA products—the introduction of a Total THC standard.

Unfortunately, this means THCA flower, vapes, and other smokable products will be effectively banned for retail sale.

What Does This Mean for You?

• THCA products are still available for purchase through the end of 2024. If you love our THCA strains and smokable products, now’s the time to stock up!
• Starting January 1, 2025, THCA products will no longer be available on retail shelves in Tennessee.
• It’s important to note that while it won’t be illegal to possess THCA, it will be illegal for retailers to sell it.

This update is a major shift for those who rely on THCA products, but it’s not all bad news. Right now, we have the largest selection of THCA flower strains we’ve ever offered, making it the perfect time to stock up!

Consider It Flowers is proud to be on the board of the Tennessee Growers’ Coalition (TGC), which, along with two other parties, is filing a lawsuit to block this new rule from going into effect.
